These Terms & Conditions ("Terms") govern your access to and use of the websites, games, online features, and related services (collectively, the "Service") offered by Silicon Games LLC, an Ohio limited liability company ("Silicon Games," "we," "us," or "our").
By accessing or using the Service — including by playing any game, creating an account, or interacting with other players — you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.
The Service is open to players of all ages, including children. By using the Service you represent that you are able to form a binding agreement with us, or that a parent or legal guardian who can do so has agreed to these Terms on your behalf.
We care about kids' privacy and aim to comply with the U.S. Children's Online Privacy Protection Act ("COPPA") and similar laws. We do not knowingly collect more personal information from a child under 13 than is reasonably necessary to participate in an activity, and we do not require a child to disclose more information than is reasonable as a condition of participation.
If an account or feature for a child under 13 collects personal information, we will seek verifiable parental consent where required by law. A parent or guardian may review their child's information, ask us to delete it, and refuse further collection by contacting us at support@silicon-games.com.
If you believe a child under 13 has provided us personal information without the required parental consent, please contact us and we will take steps to delete it.
Some features — such as paid purchases or certain online interactions — may require you to be at least 13, or to have parental consent and supervision. We may restrict or remove features for users we believe to be underage where required.

If you create an account for a child, you are responsible for supervising their use and for the activity on that account. We may suspend or terminate accounts that violate these Terms, as described in the Termination section.
Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and play our games for your own non-commercial entertainment. We reserve all rights not expressly granted to you.

We may, but are not obligated to, monitor community areas. We may remove content, mute, suspend, or ban players, and take any action we believe is appropriate to enforce these Terms or protect the community, with or without notice. We are not responsible for the conduct or content of other users.
"User Content" means anything you submit through the Service — including usernames, chat messages, community posts, and community-submitted games and the code, art, audio, and assets that make them up. The Service lets users submit games that we may review before publishing them to the community.
You retain all ownership rights you already hold in your User Content. Submitting content does not transfer ownership to us.
By submitting User Content, you grant Silicon Games a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt, publish, publicly display, distribute, and otherwise use that content for the purpose of operating, promoting, and improving the Service. This license continues for as long as your content remains on the Service and for a reasonable period afterward to allow for backups and removal.
You are solely responsible for your User Content, and you represent and warrant that:
We may, but are not obligated to, review, approve, reject, edit, label, or remove any User Content — including community games — at any time, with or without notice, for any reason, including content we consider unlawful, harmful, infringing, age-inappropriate, or otherwise objectionable. Approving or publishing a community game does not mean we endorse it or guarantee that it is safe, accurate, or functional. You play community-submitted games at your own risk.
If you believe content on the Service infringes your copyright, contact us at support@silicon-games.com with enough detail to identify the work and the allegedly infringing material. We respond to valid notices, may remove infringing content, and may terminate repeat infringers.
The Service offers both free and paid features. "Coins" are an in-platform virtual currency that may be earned through gameplay or, where offered, purchased for real money. Coins, subscriptions, cosmetics, and other paid digital goods are referred to as "Virtual Items." If you make a purchase:
Parents and guardians: you are responsible for purchases made through accounts and devices under your control, including by minors. Please supervise children and use available device-level parental and purchase controls.
The Service and all of its content — including games, software, code, graphics, characters, logos, audio, and the "Silicon Games" name and branding — are owned by Silicon Games LLC or its licensors and are protected by intellectual property laws. Except for the limited license granted above, nothing in these Terms transfers any ownership or rights to you.
The Service may rely on or link to third-party services (for example, hosting, authentication, and payment providers). Your use of those services may be governed by their own terms and privacy policies. We are not responsible for third-party services and do not endorse them.
Our collection and use of personal information is described in our Privacy Policy. By using the Service, you consent to those practices. If there is any conflict between these Terms and the Privacy Policy regarding personal information, the Privacy Policy controls for that subject.
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that any content or progress will be preserved. You use the Service at your own risk, to the fullest extent permitted by law.
To the fullest extent permitted by law, Silicon Games LLC and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service.
To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of (a) the total amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) US $50.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless Silicon Games LLC and its members, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms or any law or third-party right.
You may stop using the Service at any time. We may suspend or terminate your access or account, in whole or in part, at any time and for any reason — including violation of these Terms — with or without notice. Upon termination, your license to use the Service ends. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of- laws rules. You agree that the state and federal courts located in Ohio will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to personal jurisdiction and venue there, except where applicable law provides otherwise.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Changes are effective when posted. Your continued use of the Service after changes take effect means you accept the updated Terms.
